Abstract

As is known, with the adoption of the constitutional amendment in the Turkish Grand National Assembly comprising the conversion of Turkey's government system from parliamentary to the presidential system affiliated to the party, Turkey became acquainted with the model of “The Presidential Government System”. With this system, the executive branch of the state has been reformed. The purpose of this study is; to determine the characteristics of the decree laws of the state of emergency, to examine the effect of the amendment no. 6771 dated 16 April 2017, which is the most comprehensive constitutional amendment made to date, on the emergency decree-laws and the point of view of the Constitutional Court to these decrees, the differences between past decisions and final decisions, namely the changes in its case law.
