Abstract

Abstract In order to understand the structure and order of society in the Ottoman Empire, the legal structure of the family must be thoroughly examined. Our study focuses on the legal structure of the family in the Ottoman Empire. In order to understand the legal structure, the sources we first refer to are generally the Shar'iyya records. The beginning phase of the law in the family begins with individuals deciding on marriage and taking part in the marriage. The purpose of our study is to provide information about the rights and responsibilities of men and women to each other when they are married. As a result, the subjects such as engagement, marriage, dowry and divorce in the family were examined in detail and tried to be better understood by giving examples from Shar'iyya records.
