ESRAR HAKKINDA VERİLMİŞ ARAPÇA MANZUM BİR FETVÂ

Abstract

Mükeyyifat adı verilen esrar, afyon, tütün, kahve gibi içecekler Osmanlı şeyhülislam ve müftülerinin özellikle 16-17. yüzyıllarda en sık verdiği fetvâların konularından olmuş ve bunlardan tütün ve kahve hakkında müstakil eserler de yazılmıştır. Bu mükeyyifata dair verilen fetvâlar hep aynı yönde olmamış ve haram, mekruh, mübah gibi farklı görüşler bulunabilmiştir. Mesela kahve genellikle caiz görülürken afyon ve tütün hakkında mekruh veya haram hükmü daha öne çıkmış, esrar için verilen hüküm ise kesinlikle haram olmuştur. Esrar, Osmanlı’da haramlığı kesin olarak kabul edilmekle beraber Şeyhülislam Kemalpaşazâde’nin verdiği cevaz sebebiyle uzun süre tartışılmıştır. 16. yüzyılda esrarla ilgili birçok fetvâ verilip haram olduğu açıklanmış, bunlar arasında Arapça manzum bir fetvâ da bulunmuştur. Bu çalışmada bu fetvâ tanıtılmaktadır.

Abstract

Drinks such as cannabis, opium, tobacco, coffee, which are called mükeyyifat, were explained by the Ottoman sheikhulislams and their muftis and its has been one of the most frequently given fatwa issues in the centuries. Of these, individual works have been written especially on tobacco and coffee. Different opinions such as haram, makruh and permissible can be found in the fatwas given about this mükeyyifat. For example, while coffee is generally regarded as permissible, the provision of makruh or haram about opium and tobacco comes to the fore, and the provision for cannabis is definitely haram. Although cannabis was definitely considered forbidden in the Ottoman Empire, it was discussed for a long time due to the permissibility given by Sheikhulislam Kemalpashazade. In the 16th century, many fatwas about cannabis were given and declared to be haram. Among them, an Arabic poetry fatwa was also found. In this study, this fatwa is introduced.
