Abstract
İnsanlığın tarih boyunca gelişimini ve değişimini sağlayan şey toplulukların birbirleriyle iletişimi ve etkileşimi olmuştur. Eski dönemlerde bu iletişimi ve haberleşmeyi sağlayacak araçların yetersiz olması nedeniyle bilgi paylaşımları sınırlı olmakta iken zamanla teknolojik gelişmeler ile birlikte haberleşme ağı gelişmiş ve internet kavramı ortaya çıkmıştır. Bunun akabinde internet kullanımı ile birlikte sosyal medya platformları oluşmaya başlamıştır. Sosyal medya platformları modern dünyada insanlara fikir ve düşüncelerini rahatça paylaşabilecekleri alanlar vermektedir. İnsanlar bu şekilde günlük olayları takip ederek bu olaylara ilişkin anlık tepkilerini paylaşabilmekte ve bir kamuoyu oluşturabilmektir. Sosyal medya ağının hızlı olması nedeniyle insanlar arasında hızlı bir haberleşme ve etkileşim olmaktadır. Dolayısıyla sosyal medya hayatın birçok alanına temas etmekte ve temas ettiği alanları da etkilemektedir. Sosyal medyanın günümüzde en çok temas ettiği ve etkileşimde olduğu alan ise ceza muhakemesidir. Sosyal medya üzerinden hem kolayca suç işlenebilmekte hem de işlendiği iddia olunan suçlarla ilgili değerlendirmeler yapılabilmektedir. Zaman zaman sınırları aşan bu değerlendirmeler ile oluşturulan kitleler ceza muhakemesi süreçlerine etkide bulunmaktadır. Bu sebeple ceza hukukunun sosyal medyayla ilişkisi oldukça önem arz etmektedir. Söz konusu bu çalışmada insanların sosyal medya ile ceza yargılamalarına ne şekilde müdahil oldukları, neden böyle bir müdahaleye ihtiyaç duydukları, bu eylemlerin olumlu ve olumsuz yönlerinin neler olduğu ve olumsuz yönleri düzeltmek için neler yapılabileceğinden bahsedilecektir.

The communication and interaction of communities with each other has been what has enabled the development and change of humanity throughout history. In the old days, information sharing was limited due to the lack of tools to provide this communication and communication, while over time, along with technological developments, the communication network has improved and the concept of the Internet has emerged. Following this, social media platforms have started to be formed with the use of the Internet. Social media platforms provide opportunities for people to share their ideas and thoughts. People can form public opinion by following daily news and sharing their instant reactions. There is fast communication and interaction among people due to speed in social media. Therefore, social media is involved in many areas in our lives and has an impact on it. Nowadays, the most effective and interactive area that social media has an influence over is criminal procedure. It is possible both to commit crime and evaluate related crimes through social media. The ideas, which consist of these evaluations, can sometimes cut across and affect the process of criminal procedure. That is why, the relation between social media platforms and criminal procedure is utmost important. This article mentions how people take part in criminal procedure by using social media, the reason why this kind of interference is needed, positive and negative aspects of these situations and how we can fix the negative side of them.
