Abstract
Türkiye’de, yakın tarihte, sistem çeşitleri ile ilgili tartışmalar, Anayasa değişikliğinin oluşum süreci, değişikliğin getirdiği maddelerin uygulanma alanına yönelik eleştirel bulunmaktadır. Siyasi ve hukuki olarak, 15 Temmuz 2016 tarihli darbe girişimi sonrası ortaya çıkan yeni durum, siyasi partiler arasında ittifaklara yol açmış ve sistem değişikliği sürecinin hızlanmasına neden olmuştur. Bu yeni durum, iç ve dış unsurlardan kaynaklanan tehditlere karşı önlem almak üzere Olağanüstü Hal ilan edilmesi sonucunu doğurmuştur. 21 Temmuz 2016'da ilk kez ilan edilen Olağanüstü Hal, 19 Temmuz 2018 tarihinde Cumhurbaşkanlığı Hükümeti Sistemi döneminde kaldırılmıştır. Bu çalışmada, ilgili dönemle beraber, Cumhurbaşkanlığı kararnamelerinin kavramsal, yasal ve uygulama boyutu incelenerek, çalışmada bahsedilen eleştirel hususlar dışında, Cumhurbaşkanlığı kararnameleri uygulamalarının yerinde olduğu kanaatiyle çalışma tamamlanmıştır.

Abstract
In the recent past in Turkey, the discussions about the types of systems, the formation process of the constitutional amendment, and the application area of the articles brought by the amendment are critical. Politically and legally, the new situation that emerged after the coup attempt of 15 July 2016 led to alliances between political parties and accelerated the process of system change. This new situation resulted in the declaration of a State of Emergency to take measures against threats originating from internal and external factors. The State of Emergency, which was declared for the first time on 21 July 2016, was lifted on 19 July 2018 during the Presidential Government System. In this study, the conceptual, legal and practical dimensions of the Presidential decrees were examined, and the study was completed with the belief that the applications of the Presidential decrees are appropriate, apart from the critical issues mentioned in the study.
